NEWS RELEASE - Cannabis and Tobacco Consumption Bylaw passed

The Town of Rocky Mountain House has passed third and final reading of Bylaw 2018/35V, the Cannabis and Tobacco Consumption Bylaw, to regulate public consumption of tobacco and cannabis within the Town’s corporate limits.

This bylaw closely follows provincial regulations already in place for tobacco smoking and cannabis consumption, with additional setbacks for public and recreational facilities within Rocky Mountain House.

Sections 10 and 13 of Bylaw 2018/35V prohibit tobacco smoking and any form of cannabis consumption within five metres of any doorway, window or air intake of a public place, workplace or town-owner building, unless otherwise posted.

Sections 11 and 14 stipulate that no person shall consume tobacco or cannabis on private property without the consent or permission of the owner.

Specific setbacks apply to outdoor recreation facilities and town-owned property under Sections 12 and 15, as follows:

  • Cannabis consumption will not be allowed within five metres of the boundary to parks, playgrounds, skateparks, water-spray parks, trails, libraries, other recreational facilities used by the public, the Christenson Sports and Wellness Centre, the Credit Union Co-op Aquatic Centre and the Lou Soppit Community Centre.

  • Cannabis consumption will not be allowed at any Town of Rocky Mountain House organized events open to the public (ie: Marketplace on Main.)

  • Tobacco smoking at the Christenson Sports and Wellness Centre, Lou Soppit Community Centre and the Credit Union Co-op Aquatic Centre shall not be within five metres from a doorway, window or air intake unless otherwise posted or a Designated Smoking Area has been established.

  • Tobacco smoking will not be allowed within five metres of the Town’s baseball dugouts and all bleachers situated at any of the sports fields within Rocky Mountain House. There will be no smoking of tobacco within five metres of a sports field (ie: soccer, football or baseball).

Schedule A of Bylaw 2018/35V, which may be amended by council resolution, specifies a $250 penalty on first offence under sections 10 through 15.

Cannabis and Tobacco Consumption Bylaw 2018/35V repeals the Cannabis Consumption Bylaw that was adopted on Oct. 16, 2018.

Council will review this bylaw in June 2019.
